OBJETIVO / OBJECTIVE

Definir las bases mediante las cuales el OEC del CCC |ISCB, opera de manera independiente de las partes interesadas, para otorgar la certificación de competencias laborales a las personas que lo requieran bajo las normas establecidas por el esquema de certificación, reduciendo el riesgo de conflictos de interés, garantizando la imparcialidad, independencia e integridad de sus políticas y procedimientos y asegurando, así mismo, que los principios de objetividad, respeto, confidencialidad, y justicia, sean aplicados en todas sus operaciones.

ALCANCE / REACH

El presente Manual es aplicable a todos los actores pertenecientes al OEC del CCC |ISCB, solicitantes, candidatos y personas certificadas, hace parte integral de los requisitos contractuales suscritos entre las partes, y que rigen la certificación de competencias laborales y cualquier otro servicio de certificación que sea solicitado al OEC del CCC |ISCB. Este Manual aplica a las actividades de solicitud, evaluación, certificación de la certificación, además establece directrices sobre la ampliación, reducción de alcances, suspensión y retiro de certificados.

1. DEL ORGANISMO DE CERTIFICACIÓN / FROM THE CERTIFICATION BODY

   1. Promover y mantener el Esquema de Certificación de Personas, conforme a las normas aplicables.

   2. Gestionar la información documentada propia de cada esquema de Certificación.

      Manage the documented information of each Certification scheme.

   3. Establecer las sanciones correspondientes en cada caso, tanto al personal del OEC del CCC

      |ISCB, como a los candidatos a la certificación y personas certificadas.

      Establish the corresponding sanctions in each case, both for CCC | ISCB OEC staff, as well as for certification candidates and certified persons.

   4. Delegar, bajo su responsabilidad, la administración de los instrumentos de evaluación, así como su aplicación y calificación, a otras personas, quienes actuaran como par evaluadores.    5. Establecer los controles para evitar tentativas de fraude en los procesos de evaluación.

   7. Gestionar todas aquellas actividades o relaciones que pudieren generar un riesgo a la imparcialidad de la organización.

   8. Evaluar y controlar a los pares evaluadores, en forma directa o indirecta controlándolos de manera periódica.

   9. Realizar la emisión, mantenimiento, ampliación, reducción, suspensión o retiro de los Certificados, y mantener actualizados los registros de las personas certificadas.

   10. Notificar al Comité del Esquema de cualquier cambio en los requisitos de la Certificación. Una vez aprobados por el Comité del Esquema, el OEC del CCC |ISCB deberá informar a las partes interesadas y a las personas certificadas.

2. DEL COMITÉ DEL ESQUEMA / OF THE SCHEME COMMITTEE

    

   1. Revisar, validar y actualizar los esquemas de certificación

      Review, validate and update the certification schemes

   2. Aprobar los instrumentos de evaluación dispuestos para las competencias a certificar cada vez que se requiera.

      Support certification renewal activities, proposing the frequency and content of these.

   3. Revisar la pertinencia de los instrumentos de evaluación, como resultado de su ampliación, modificación o reemplazo en concordancia con las exigencias del esquema de certificación.    4. Revisar que los riesgos gestionados por la organización son los adecuados para garantizar el cumplimiento con los referentes normativos.

   5. Proponer la incorporación de nuevos alcances, sectores industriales para los procesos de certificación.

3. DE LOS PAR EVALUADORES / FROM THE EXAMINERS

    

   1. Realizar su labor cumpliendo los requisitos establecidos por el OEC del CCC |ISCB.

      Carry out their work complying with the requirements established by the OEC of the CCC | ISCB.

   2. Asegurar su imparcialidad con respecto a cada candidato, dando a conocer al OEC del CCC

      |ISCB cualquier situación o amenaza potencial a la imparcialidad.

      Ensure their impartiality with respect to each candidate, informing the CCC | ISCB OEC of any situation or potential threat to impartiality.

   3. Llevar toda la información documentada relacionada con las actividades encomendadas como par evaluador.

      Bring all the documented information related to the activities entrusted as an examiner.

   4. Tener los recursos y experiencia necesaria para monitorear y controlar los instrumentos de evaluación.

      Have the necessary resources and experience to monitor and control the evaluation instruments.

       

   5. Firmar una cláusula de confidencialidad en la cual se estipula que los documentos suministrados por el OEC del CCC |ISCB y que contienen información expresa de procesos internos, manuales de operación de maquinaria y equipo y manuales de calidad y seguridad industrial de la empresa en la que laboran los candidatos que son patrocinados y que son requerimientos para la aplicación de los instrumentos de evaluación, se utilizarán únicamente como medio informativo, bajo ninguna circunstancia esta información deberá ser divulgada, reproducida o utilizada con fines diferentes.

4. DEL SOLICITANTE / FROM APPLICANT

   1. No tener o haber tenido litigios con el OEC del CCC |ISCB, por incumplimiento de contratos o prestación de servicios.

   2. Acatar las condiciones obligatorias de seguridad establecidas en el F-CER-02 Solicitud de Certificación.

   3. Presentar toda la documentación requerida por el OEC del CCC |ISCB, que acredite la información recibida, experiencia laboral y requisitos específicos de cada proceso de certificación.

   4. Asumir todos los costos relacionados con el proceso de Certificación (Costos Administrativos, exámenes de calificación, viáticos de evaluadores cuando corresponda), en la forma que sea indicada por el OEC del CCC |ISCB.

   5. Acatar las disposiciones establecidas por el Esquema de Certificación correspondiente.

   6. No utilizar el certificado en forma engañosa de forma tal que desacredite al OEC del CCC |ISCB

   7. Dar cumplimiento al Manual de Funciones y a las condiciones de uso del certificado.

CONDICIONES GENERALES / GENERAL CONDITIONS

El OEC del CCC |ISCB presta servicios de certificación de personas y puede proveer sus servicios a su absoluta discreción, mediante su propio personal o delegándola a otra persona u organización. Cuando parte del trabajo es delegado, el OEC del CCC |ISCB conserva su responsabilidad para otorgar, mantener, extender y reducir el alcance de la certificación o para suspenderla o retirarla, así como el aseguramiento del cumplimiento de los requisitos de seguridad y confidencialidad de la información, independencia e integridad para los contratistas externos. El OEC del CCC |ISCB no contrata externamente la decisión de la certificación.

El Organismo cuenta con un procedimiento de Certificación de personas y con instructivos específicos de acuerdo al esquema de certificación, los cuales contienen los elementos necesarios que permiten comprobar la competencia laboral de una persona, apoyados en par evaluadores idóneos, debidamente autorizados por el OEC del CCC |ISCB.

El Organismo de Certificación en cabeza del Director Técnico recibe y evalúa la información aportada por el candidato y el par evaluador emite un juicio de acuerdo con los resultados obtenidos en la aplicación de los instrumentos de evaluación y la conformación del portafolio de evidencias, posteriormente el Director Técnico tomar la decisión de certificación.

DESCRIPCIÓN DE ACTIVIDADES / DESCRIPTION OF ACTIVITIES

1. SOLICITUD DE SERVICIOS DE CERTIFICACIÓN

   APPLICATION FOR CERTIFICATION SERVICES

   La solicitud es la presentación de una persona para que sea admitido en el proceso de certificación; dicha solicitud proviene de la persona interesada en la certificación presentándose esta de manera voluntaria, esta persona podrá ser patrocinada por terceros (Personas, persona u empresas) de forma voluntaria, en cuyo caso dicho patrocinio solo se limitará a la presentación del nombre de la persona y dado el caso al pago de los servicios prestados por el OEC del CCC |ISCB. Bajo ninguna circunstancia las personas, persona o empresas que actúen como patrocinadores podrán interferir en el proceso de certificación garantizando de esta manera la imparcialidad, independencia e integridad del proceso. El pago de los servicios del OEC del CCC |ISCB por parte de patrocinadores no acarrea obligaciones entre el Organismo de Certificación y el patrocinador, de igual manera no genera compromiso de certificación.

      Todos los solicitantes que cumplen con prerrequisitos de formación tienen los mismos requisitos de evaluación y certificación independientemente del sitio donde dicha formación haya sido cursada y/o aprobada.

2. CONSIDERACIÓN DE SOLICITUDES ESPECIALES

   CONSIDERATION OF SPECIAL REQUESTS

   El solicitante podrá documentar y declarar necesidades especiales y dentro de lo razonable para considerar su solicitud.

   Se procede a realizar un análisis con el Director Técnico y el Director de Calidad de tal manera que la necesidad especial no ponga en tela de juicio la veracidad de los procesos de evaluación, además que se garantice que esta no se preste para cometer fraude en el proceso de evaluación.

3. SOLICITUDES INCOMPLETAS

   Si se presenta una solicitud incompleta, el OEC del CCC |ISCB solicitará el cumplimiento total de los requisitos y otorgará un tiempo prudencial para tal fin. En caso de que la solicitud de cumplimiento total de los requisitos se solicite con posterioridad al proceso de evaluación, o porque se obviará u omitiera algún prerrequisito no advertido en el proceso de solicitud, el OEC podrá suspender sin previo aviso el proceso independientemente del avance del mismo. Una vez suspendido el proceso por este motivo, se notificará a la parte afectada para que proceda a la

    

   completitud de la información y documentos faltantes, lo cual deberá cumplir en un tiempo no superior a diez (10) días hábiles luego de recibir la notificación.

   Si no se cumpliera ni el plazo ni la información o documentos faltantes, se entenderá que el solicitante desiste del proceso y el proceso será anulado sin perjuicio de lo actuado. El OEC se reserva el derecho de solicitar información adicional para el proceso en cualquier etapa del mismo, la cual deberá aportarse en el plazo aquí estipulado, so pena de la anulación del proceso por desistimiento del mismo.

   If neither the deadline nor the missing information or documents are met, it will be understood that the applicant desists from the process and the process will be annulled without prejudice to the action. The OEC reserves the right to request additional information for the process at any stage, which must be provided within the term stipulated herein, under penalty of canceling the process due to its withdrawal.

    

4. REVISIÓN DE LA SOLICITUD / INCOMPLETE APPLICATIONS

   El Auxiliar administrativo estudiará la solicitud con el fin de garantizar que CCC|ISCB está en condiciones de prestar el servicio de certificación, y el solicitante cumple los prerrequisitos establecidos en el Esquema de Certificación pertinente, de igual manera se verifica que:

   The Administrative Assistant will study the application in order to ensure that CCC | ISCB is in a position to provide the certification service, and the applicant meets the prerequisites established in the relevant Certification Scheme, in the same way it is verified that:

    

   1. El OEC y el par evaluador asignado, tienen la capacidad requerida para proveer el servicio solicitado.

   2. El OEC y el par evaluador asignado, son conscientes y pueden dentro de lo razonable, satisfacer las necesidades especiales de los solicitantes.

      The CAB and the assigned examiner are aware of and can within reason meet the special needs of applicants.

       

      La oportunidad, veracidad y exactitud de la información declarada e incluida en la solicitud permitirá planificar adecuadamente las actividades del proceso de certificación de la competencia, si durante el transcurso del proceso el OEC del CCC |ISCB tiene conocimiento que la información suministrada no es veraz, el proceso será cancelado inmediatamente, en caso de que el solicitante hubiese terminado el proceso y se le hubiera concedido la certificación, está será cancelada y retirada inmediatamente. Lo anterior no excluye la posibilidad, si el certificado no es devuelto al OEC del CCC |ISCB, de emprender las acciones legales pertinentes.

      El solicitante debe diligenciar a través de la página web el F-CER-02 Solicitud de Certificación (http://col.iscertificationboard.org/index.php/certificacion/solicitud-de-certificacion), el cual, permite adjuntar los soportes requeridos de acuerdo al esquema de certificación a aplicar, una vez diligenciado será enviado de manera virtual para ser coherentes con el cuidado de los recursos y no generar impresión de documentos si no es necesario.

      La revisión de la solicitud la realiza la Auxiliar Administrativa a través del F-CER-09 Revisión de Documentos primera parte, validando el cumplimiento de los prerrequisitos establecidos en el Esquema de Certificación aplicado.

      En el caso de existir algún tipo de impedimento o situación que no permita el acceso del solicitante al proceso de certificación, este será comunicado por correo electrónico.

5. ACEPTACIÓN DE LA SOLICITUD / ACCEPTANCE OF THE APPLICATION

   Si la solicitud cumple con todos los prerrequisitos establecidos por el Esquema de Certificación correspondiente, será aceptada y se notificará al solicitante de manera inmediata o durante los cinco

   (5) días hábiles siguientes a la presentación de la solicitud.

   La notificación de la aceptación de la solicitud será enviada por vía mail, para continuar con el proceso de evaluación y certificación, junto con el usuario y contraseña para realizar el seguimiento de su estado de certificación en la página web y el link de acceso a la plataforma ZOOM para los casos de evaluación remota.

   En caso de no ser aprobada se responderá con mail, informando los motivos por los cuales no es aceptado y no se genera usuario y contraseña, hasta no cumplir la totalidad de los pre-requisitos. 6. DESISTIMIENTO DE LA SOLICITUD / WITHDRAWAL OF THE APPLICATION

   Si el solicitante desiste del proceso de certificación, luego de formalizado el mismo y antes de iniciar la evaluación, el Organismo de Certificación retendrá el 50% del valor cancelado, como multa por incumplimiento.

   If the applicant desists from the certification process, after it has been formalized and before starting the evaluation, the Certification Body will retain 50% of the canceled value, as a fine for non-compliance.

    

   1. PROGRAMACIÓN DE LA EVALUACIÓN / SCHEDULING THE EVALUATION

      El Evaluador genera el usuario y la clave para el candidato y define la programación de la evaluación escrita y práctica de este, la cual podrá llevarse a cabo de manera inmediata a la solicitud o posterior a esta. En cualquiera de los casos el Organismo informará de manera oportuna al aspirante vía correo electrónico.

      The Evaluator generates the username and password for the candidate and defines the scheduling of the written and practical evaluation of the candidate, which may be carried out immediately after the application or after it. In any case, the Agency will inform the applicant in a timely manner via email.

       

      En el caso de las empresas que patrocinen el proceso de certificación deberá concertarse primero una reunión con la empresa a fin de determinar de manera precisa el puesto de trabajo del candidato. La empresa deberá facilitar al representante autorizado por el OEC del CCC |ISCB los manuales de procedimiento de las actividades de cada puesto de trabajo, operación de maquinaria y equipos, calidad y seguridad industrial relacionados con los candidatos a la certificación con tiempo suficiente para que el par evaluador prepare de manera adecuada los instrumentos de evaluación.

      In the case of companies sponsoring the certification process, a meeting must first be arranged with the company in order to determine precisely the job title of the candidate.       En caso de que el personal involucrado en la evaluación del candidato manifieste un potencial conflicto de interés, este deberá diligenciar el F-RH-14 Declaración De Conflicto De Interés, registrando como medida adicional para salvaguardar la confidencialidad e imparcialidad de la evaluación el nombramiento de un Supervisor.

      In the event that the personnel involved in the evaluation of the candidate manifest a potential conflict of interest, this will be consigned in the conflict of interest treatment matrix, registering as an additional measure to safeguard the confidentiality and impartiality of the evaluation the appointment of a Supervisor.

       

   2. EJECUCIÓN DE LA EVALUACIÓN / EXECUTION OF THE ASSESSMENT

      Al iniciar el proceso de ejecución de la evaluación, el par evaluador deberá confirmar la identidad de los candidatos solicitando su Documento de Identificación.

      When starting the evaluation execution process, the examiner must confirm the identity of the candidates by requesting their Identification Document.

       

      El par evaluador informa los siguientes requisitos a los candidatos cuando se encuentran en el proceso de evaluación, garantizando su cumplimiento a través de F-CER-09 Revisión de Documentos segunda parte:

      En sitio / In place:

      1. Se prohíbe el uso de cámaras fotográficas, videocámaras, celulares u otro tipo de dispositivo de grabación, fotografía o escaneo.

      2. Señalar la respuesta según instrucción de la evaluación. Las preguntas dónde se señale más de una respuesta o no se indique respuesta se considerarán erróneas.

      3. No se permite utilizar documentación de consulta en las evaluaciones.

         Reference documentation is not allowed in assessments.

      4. Los candidatos convocados a los exámenes tendrán derecho a conocer los tiempos y características de las evaluaciones teóricas y prácticas, estructura, forma de responder y corregir, así como los criterios de calificación.

         The candidates summoned to the exams will have the right to know the times and characteristics of the theoretical and practical evaluations, structure, way of answering and correcting, as well as the qualification criteria.

      5. Los candidatos convocados a la evaluación tienen derecho a pedir cambio de par evaluador comunicándolo al Director Técnico, justificando las causas concretas. El Director Técnico analizará la solicitud y, si esta es justificada, el candidato será reprogramado.

         Candidates summoned to the evaluation have the right to request a change of examiner by communicating it to the Certification Coordinator, justifying the specific causes. The Certification Coordinator will analyze the request and, if it is justified, the candidate will be rescheduled.

      6. El candidato debe seguir en todo momento las normas indicadas por el par evaluador durante el desarrollo de las evaluaciones teóricas y prácticas, una vez finalizada la evaluación, el candidato debe regresar la totalidad del material suministrado. En caso contrario y de demostrar conducta fraudulenta, podrán ser anuladas las pruebas.

         The candidate must follow at all times the rules indicated by the examiner during the development of the theoretical and practical evaluations, once the evaluation is finished, the candidate must return all the material provided. Otherwise and to demonstrate fraudulent conduct, the tests may be annulled.

      7. Si alguno de los candidatos utiliza durante la presentación de las evaluaciones material no autorizado, celulares, cámaras, videograbadoras o se comunica con cualquier otro candidato o persona, con ánimo de obtener información para la evaluación, éste será anulado. Esto implica que no podrá aplicar nuevamente a ninguna de las certificaciones ofrecidas por el OEC del CCC |ISCB durante un periodo de 2 años y no excluye la posibilidad de emprender acciones legales contra el candidato.

      If any of the candidates uses unauthorized material, cell phones, cameras, video recorders during the presentation of the evaluations or communicates with any other candidate or person, in order to obtain information for the evaluation, this will be annulled. This implies that you will not be able to apply again to any of the certifications offered by the OEC of the CCC | ISCB for a period of 2 years and does not exclude the possibility of taking legal action against the candidate.

Esto implica que no podrá aplicar nuevamente a ninguna de las certificaciones ofrecidas por el OEC del CCC |ISCB durante un periodo de 2 años y no excluye la posibilidad de emprender acciones legales contra el candidato.

   3. PROCEDIMIENTO DE EVALUACIÓN / EVALUATION PROCEDURE

      Para obtener el Certificado como Examinador Poligráfico, Examinador Poligráfico Profesional, Auditor Poligráfico y Oficial de Cumplimiento los CANDIDATOS deberán aprobar con nota mayor o igual a 80% / 100% las evaluaciones teóricas y prácticas, que se componen de:

      To obtain the Certificate as a Polygraphic Examiner, Professional Polygraphic Examiner, Polygraphic Auditor and Compliance Officer, the CANDIDATES must pass with a grade greater than or equal to 80% / 100% the theoretical and practical evaluations, which are composed of:

       

      • Un test Estandarizado de Evaluación con preguntas de selección múltiple con única respuesta, preguntas de falso o verdadero y preguntas de apareamiento.

      • Un examen de Desempeño orientado por la F-CER-06 Matriz Evaluación Práctica para la certificación de Examinador Poligráfico, Examinador Poligráfico Profesional.

   4. RESULTADO DE LA EVALUACIÓN / RESULT OF THE EVALUATION

      La interpretación de los resultados de evaluación se realizará de conformidad con lo estipulado en el Esquema de certificación correspondiente al alcance evaluado.

      The interpretation of the evaluation results will be carried out in accordance with the provisions of the Certification Scheme corresponding to the evaluated scope.

       

   5. CERTIFICACIÓN / CERTIFICATION

   Para obtener la certificación, el candidato deberá cumplir con todos los requisitos establecidos por el esquema de certificación correspondiente, además de aprobar satisfactoriamente las evaluaciones que permiten la recolección de evidencia de su competencia.

   To obtain certification, the candidate must meet all the requirements established by the corresponding certification scheme, in addition to successfully passing the evaluations that allow the collection of evidence of their competence.

    

   El Director Técnico será quién toma la decisión de certificación del candidato, previa recolección y análisis de las evidencias correspondientes a la documentación presentada, resultados de la evaluación escrita y práctica.

   El OEC del CCC |ISCB comunicará la decisión al candidato en un plazo no mayor a ocho (8) días luego de la recepción del informe del par evaluador.

   La vigencia es por el periodo de un año y contará a partir de la expedición de la escarapela de certificación, una vez transcurrido este periodo la Persona Certificada deberá presentar nuevamente las evaluaciones correspondientes al alcance de su certificación.

   Una vez cumplidos los requisitos del esquema y obtenida la certificación el candidato deberá firmar el Contrato de Certificación.

   1. RENOVACIÓN / RENEWAL

      El esquema tiene una periodo de validez de un año, por lo tanto no se tendrá procesos de renovación, si desea obtener nuevamente la certificación, se deberá iniciar todo el proceso desde cero.

      The scheme has a validity period of one year, therefore there will be no renewal processes, if you want to obtain the certification again, you must start the whole process from scratch.

       

   2. AMPLIACIÓN, REDUCCIÓN, SUSPENSIÓN, RETIRO O CANCELACIÓN DE LA CERTIFICACIÓN

      EXTENSION, REDUCTION, SUSPENSION, WITHDRAWAL OR CANCELLATION OF CERTIFICATION

      El OEC del CCC |ISCB, cuenta con políticas claras para dirimir conflictos respecto a la certificación, cuando por razones motivadas se tenga que reducir su alcance, suspender o retirar.

      The OEC of the CCC | ISCB, has clear policies to resolve conflicts regarding certificationl, when for motivated reasons its scope has to be reduced, suspended or withdrawn.

       

      El retiro, suspensión, reducción o cancelación del certificado se informará a la persona certificada por escrito, comunicándole las razones de esta decisión.

      The withdrawal, suspension, reduction or cancellation of the certificate will be informed to the certified person in writing, communicating the reasons for this decision.

       

      Se podrá renovar el certificado cancelado, reducido o suspendido por sanciones impuestas, una vez sea revisado y resuelto el aspecto que dio origen a la novedad, y que haya sido rectificada y notificada por parte del OEC del CCC |ISCB.

      The certificate canceled, reduced or suspended due to imposed sanctions may be renewed, once the aspect that gave rise to the novelty has been reviewed and resolved, and that it has been rectified and notified by the OEC of the CCC | ISCB.

       

      1. AMPLIACIÓN / ENLARGEMENT

         Cuando una persona certificada no haya cumplido el tiempo para recertificación y desee la ampliación de su alcance, se requiere lo siguiente:

         When a certified person has not completed the time for recertification and wishes to extend their scope, the following is required:

          

         1. Presentar solicitud escrita al OEC manifestando su deseo de ampliar el alcance.

            Submit a written request to the OEC stating your desire to expand the scope.

         2. Presentar los soportes de haberse desempeñado en lo relacionado con la solicitud de ampliación; conforme a lo estipulado en el esquema de certificación correspondiente.

         3. Si no se ha cumplido el tiempo para la recertificación se realizará solo el proceso de evaluación práctica.

      2. REDUCCIÓN / REDUCTION

         En el proceso de certificación, el OEC del CCC |ISCB, podrá reducir el alcance de la certificación inicialmente requerida por el candidato; bien sea dentro del proceso evaluativo inicial, o como resultado de las actividades de vigilancia, mediante resolución motivada; tomando en cuenta que puede presentarse un déficit y/o pérdidas de competencias que sean requeridas para el nivel de certificación inicialmente solicitado por el candidato, según el alcance.

      3. SUSPENSIÓN / SUSPENSION

         El OEC del CCC |ISCB, podrá suspender provisionalmente en cualquier momento la certificación, cuando se presenten cualquiera de los casos siguientes:

         1. Cuando se incumpla por parte de la persona certificada, aspectos al Reglamento de Certificación de Personas, el Manual de Funciones, o la pérdida de competencias por problemas físicos temporales.

            When the certified person fails to comply with the Personnel Certification Regulations, the Duties Manual, or the loss of powers due to temporary physical problems.

         2. El incumplimiento a sus deberes y responsabilidades, que le fueron notificados al candidato.

         De igual forma para la suspensión se tiene en cuenta el seguimiento y vigilancia realizada a la persona certificada, y los aspectos notificados por los contratantes, sobre el desempeño de la persona certificada.

      4. RETIRO O CANCELACIÓN / WITHDRAWAL OR CANCELLATION

         Las certificaciones otorgadas por el OEC del CCC |ISCB, serán retiradas o canceladas, por los siguientes aspectos:

         The certifications granted by the OEC of the CCC | ISCB, will be withdrawn or canceled, due to the following aspects:

          

         1. Por sanciones impuestas por el organismo de certificación al incumplimiento de las disposiciones establecidas en el Reglamento de Certificación de Personas, las violaciones al Manual de Funciones en que incurra la persona certificada durante el desarrollo de sus tareas, verificadas a través del proceso de gestión para el seguimiento y mantenimiento de certificados. Due to sanctions imposed by the certification body for non-compliance with the provisions established in the Personnel Certification Regulation, violations of the Manual of Functions incurred by the certified person during the development of their tasks, verified through the management process for the monitoring and maintenance of certificates.

         2. Por vencimiento del certificado y no recertificación.

   3. SANCIONES / SANCTIONS

      Las sanciones son consecuencia del no cumplimiento del Manual de Funciones, el Reglamento de Certificación de Personas y el acuerdo de uso de la certificación, y serán aplicadas por el OEC del CCC |ISCB a quienes se hagan merecedoras de ellas.

      The sanctions are the consequence of non-compliance with the Function Manual, the Personnel Certification Regulations and the certification use agreement, and will be applied by the OEC of the CCC | ISCB to those who deserve them.

       

      Las sanciones serán recomendadas por el Director Técnico y ratificadas por el Gerente, previo análisis de los hechos soportados en las evidencias correspondientes y con el debido proceso documentado.

      The sanctions will be recommended by the Technical Director and ratified by the Manager, after analyzing the facts supported by the corresponding evidence and with the documented due process.

       

      Las sanciones se enmarcan en los siguientes parámetros:

      1. Llamado de atención por escrito por el OEC del CCC |ISCB.

         Written call for attention by the OEC of the CCC | ISCB.

      2. Suspensión por un término máximo de un (1) mes cuando por causas no justificadas la persona certificada no se presente a la vigilancia.

         Suspension for a maximum term of one (1) month when for unjustified reasons the certified person does not appear for surveillance.

      3. Cancelación y retiro en los casos que al término de la suspensión temporal la persona no se hizo presente para dar cumplimiento a la vigilancia, teniendo que iniciar nuevamente el proceso de certificación.

         Cancellation and withdrawal in the cases that at the end of the temporary suspension the person did not appear to comply with the surveillance, having to start the certification process again.

      4. Cancelación definitiva del certificado y exclusión permanente del registro y control de personas certificadas por faltas graves al Manual de Funciones.

         Definitive cancellation of the certificate and permanent exclusion from the registry and control of persons certified for serious misconduct in the Function Manual.

      5. En cualquier tipo de retiro del Certificado, la persona certificada que es sancionada deberá hacer devolución inmediata del carné o certificado al OEC del CCC |ISCB.

      In any type of withdrawal of the Certificate, the certified person who is sanctioned must immediately return the card or certificate to the OEC of the CCC | ISCB.

       

   4. DESCARGOS / DOWNLOADS

      Los descargos son acciones a las que tiene derecho el candidato a certificación o persona certificada, que se encuentra señalada de haber incumplido el Manual de Funciones. Por lo tanto, para poder llevar a cabo dichos descargos se debe considerar:

      Discharges are actions to which the certification candidate or certified person is entitled, who is indicated to have breached the Functions Manual. Therefore, in order to carry out such discharges, the following must be considered:

       

      1. Todo proceso que se adelante, en relación con una persona certificada o en proceso de certificación, debe ser comunicada por escrito al igual que las decisiones tomadas por el OEC del CCC |ISCB.

         Any process that is carried out, in relation to a certified person or in the process of certification, must be communicated in writing as well as the decisions made by the OEC of the CCC | ISCB.

      2. Una vez el candidato a la certificación o persona certificada reciba la notificación debe presentar sus descargos en un término no mayor a cinco (5) días hábiles. De no hacerlo se considera aplicable la sanción que el OEC defina.

         Once the candidate for certification or certified person receives the notification, they must submit their discharges within a term of no more than five (5) business days. Failure to do so is considered applicable the sanction that the CAB defines.

      3. El Director Técnico, y teniendo presente la información recibida tomará una decisión y la comunicará al Gerente quién analizará el informe y ratificará o no la decisión sugerida. Dichas decisiones deberán comunicarse al interesado en un plazo no superior a veinte (20) días hábiles.

      Nota: Dado que los certificados son de propiedad del OEC del CCC |ISCB, en caso de aplicarse una sanción definitiva se debe realizar la devolución de estos en un plazo no superior a cinco (5) días hábiles luego de haberse notificado la sanción.

      El no cumplimiento del presente Manual, el Manual de Funciones y/o las condiciones de uso del certificado, así como la no devolución oportuna del certificado o el no colaborar con las actividades propias del mantenimiento y vigilancia de la certificación, son causas para que el OEC del CCC

      |ISCB, se reserve el derecho de aceptar nuevamente una solicitud de certificación.

      Failure to comply with this Manual, the Function Manual and / or the conditions of use of the certificate, as well as the non-timely return of the certificate or failure to collaborate with the activities of the maintenance and monitoring of the certification, are causes for the OEC of the CCC | ISCB, reserves the right to accept a request for certification again.

       

   5. CONFIDENCIALIDAD / CONFIDENTIALITY

      1. El OEC del CCC |ISCB se compromete a no publicar los instrumentos de evaluación, ni a dar a conocer los resultados de su aplicación a terceras personas que no hayan sido autorizadas por el candidato y/o persona certificada.

         The OEC of the CCC | ISCB undertakes not to publish the evaluation instruments, nor to disclose the results of their application to third parties who have not been authorized by the candidate and / or certified person.

      2. Toda la documentación que contenga información del candidato será archivada en lugares de acceso restringido a personal no autorizado.

      3. El Gerente, el Director Técnico, los integrantes del Comité del Esquema, los par evaluadores y demás personal del OEC del CCC |ISCB, se comprometen a cumplir con el compromiso de confidencialidad durante y después del proceso de certificación.

          

         The Manager, the Certification Coordinator, the members of the Scheme Committee, the examiners and other staff of the CCC | ISCB OEC, undertake to comply with the confidentiality commitment during and after the certification process.

      4. Se divulgará información confidencial cuando la Ley lo solicite, notificando a la persona en cuestión que información será suministrada, a menos que la Ley lo prohíba.

   6. INFORMACIÓN PÚBLICA / PUBLIC INFORMATION

   1. QUEJAS Y APELACIONES / COMPLAINTS AND APPEALS

      Los Certificados otorgados por el OEC del CCC |ISCB no implicarán para éste, responsabilidad de ningún tipo por reclamos referidos por pérdida, gasto o daño de los mismos, incluyendo los costos derivados del mal uso o por violación de los compromisos aceptados por la persona certificada al aceptar el Manual de Funciones, el Acuerdo de uso del Certificado y el presente manual.

      The Certificates granted by the OEC of the CCC | ISCB will not imply responsibility of any kind for claims referred for loss, expense or damage thereof, including costs derived from misuse or violation of the commitments accepted by the certified person. by accepting the Features Manual, the Certificate Use Agreement and this manual.

       

      Si un candidato, persona certificada o parte interesada requiere efectuar una queja ante el OEC del

      CCC |ISCB, podrá realizarlo conforme a las directrices de atención al usuario.

      If a candidate, certified person or interested party requires to file a complaint with the OEC of the CCC | ISCB, they may do so in accordance with the user service guidelines.

       

      Si las personas interesadas se consideran perjudicadas por los resultados o decisiones tomadas en el proceso de solicitud, evaluación o decisión de la certificación en otorgamiento, deberá apelar ante el OEC conforme al procedimiento de apelaciones.

       

      If the interested persons are considered harmed by the results or decisions made in the process of application, evaluation or decision of the certification in granting, they must appeal to the OEC in accordance with the appeals procedure.

       

      El OEC, responderá la apelación en un periodo no superior a quince (15) días hábiles luego de haberla recibido, evaluando la validez reuniendo y verificando toda la información que soporta la toma de la decisión.

      El OEC del CCC |ISCB establece que las apelaciones deben ser fundamentadas y solo en los siguientes casos:

      a. Desacuerdo con las decisiones que sean tomadas en el proceso de solicitud, evaluación y decisión de la certificación en otorgamiento.

      Quienes participen en la recepción, validez, investigación y comunicación al apelante de los resultados, deberán cumplir con los requerimientos de confidencialidad establecidos por el OEC del CCC |ISCB, de la misma forma la decisión que se comunicará al apelante debe tomarse, o bien revisarse o aprobarse, por personal que no haya intervenido en el objeto de la apelación (Solicitud, examen, pruebas, decisión de otorgar, mantener, suspender o retirar), caso en el que se designará al equipo encargado de adelantar la investigación, análisis y toma de la decisión.

   2. USO DE CERTIFICADOS, LOGOTIPOS Y MARCAS

      El OEC del CCC |ISCB es el único titular de los certificados emitidos, los cuales están elaborados de acuerdo con la imagen corporativa y están identificados con un número interno secuencial. El OEC es la única entidad facultada para otorgar o retirar la autorización de su uso, así como de mantener la certificación.

      The OEC of the CCC | ISCB is the sole holder of the certificates issued, which are prepared in accordance with the corporate image and are identified with a sequential internal number. The CAB is the only entity empowered to grant or withdraw authorization for its use, as well as to maintain the certification.

       

      Todos los certificados de competencia laboral otorgados están referenciados en una base de datos de consulta pública donde se indica el documento de identidad de la persona certificada, número del certificado, norma de competencia laboral en la cual fue otorgado, vigencia y estado (Vigente, suspendido o retirado).

      All the certificates of labor competence granted are referenced in a public consultation database where the identity document of the certified person, number of the certificate, norm of labor competence in which it was granted, validity and status (in force, suspended or withdrawn).

       

      Una vez otorgado el certificado, la persona certificada tiene derecho a hacer uso del símbolo del OEC del CCC |ISCB con referencia a su condición de certificado bajo las condiciones establecidas en el Acuerdo de uso de Certificado y este manual.

      La persona certificada podrá utilizar el certificado una vez este sea entregado y debe asegurarse que cuando haga alusión al mismo, utilice la siguiente frase “Certificación otorgada por el OEC del CCC |ISCB, número XXX con vigencia de (dd/mm/aa) a (dd/mm/aa)”

      The certified person may use the certificate once it is delivered and must ensure that when referring to it, use the following phrase "Certification granted by the OEC of the CCC | ISCB, number XXX with validity of (dd / mm / yy) to (dd / mm / yy) "

       

      Está prohibido a los solicitantes el uso del símbolo de certificación o su referencia a la condición de “certificado” hasta no habérsele otorgado la certificación. El incumplimiento de este numeral originará la cancelación de la solicitud, independientemente de la fase en la que se encuentre el proceso de certificación.

      Applicants are prohibited from using the certification symbol or its reference to “certified” status until certification has been granted.       Adicional el certificado llevará el logo símbolo del Organismo Acreditador del CCC, de acuerdo con los compromisos obtenidos con el reglamento de acreditación, en este caso con el ONAC.    3. MODIFICACIÓN DE LOS REQUISITOS DE EVALUACIÓN

      Cuando el Comité del Esquema autorice cambios en los requisitos de certificación, el OEC del CCC

      |ISCB notificará de dichos cambios al personal certificado que se vea afectado por dichos cambios, con el fin de que tengan tiempo de ajustarse a los establecidos. El OEC del CCC |ISCB documentará y pondrá a disposición del público, sin solicitud previa, los métodos y mecanismos específicos para verificar que las personas certificadas cumplan con los requisitos mencionados.

      When the Scheme Committee authorizes changes in the certification requirements, the CCC | ISCB CAB will notify the certified personnel affected by said changes of said changes, so that they have time to adjust to those established.    4. MODIFICACIÓN MANUAL DE CERTIFICACIÓN
